Terms of Service

Welcome to hight. These Terms of Service ("Terms") govern your access to and use of the hight platform, including our website at hight.ai, tracking scripts, APIs, dashboards, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and that organization.

2. Description of Service

hight is a privacy-first, real-time analytics platform that helps you understand what drives conversions. The Service includes:

  • Website and product analytics (page views, visitor insights, UTM campaign tracking)
  • Session replays and heatmap recordings
  • Funnel analysis, conversion goal tracking, and attribution reporting
  • Custom event tracking and revenue analytics
  • AI-powered analytics assistant for natural language data queries
  • Link tracking and pixel tracking
  • Real-time analytics dashboards
  • APIs and integrations

3. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and not share it with third parties
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 16 years of age to create an account. We reserve the right to suspend or terminate accounts that are found to contain inaccurate information.

4. Subscriptions and Payment

4.1 Plans and Pricing

The Service is offered through tiered subscription plans (Starter, Growth, and Scale) with monthly or annual billing options. Pricing and plan details are available on our pricing page. All fees are stated in U.S. dollars.

4.2 Free Trial

New accounts may be eligible for a 7-day free trial. At the end of the trial period, your account will be upgraded to a paid plan unless you cancel before the trial expires. We may modify or discontinue free trials at any time.

4.3 Billing and Renewal

Subscriptions renew automatically at the end of each billing period (monthly or annual) unless you cancel before the renewal date. You authorize us to charge your payment method on file through our payment processor, Stripe.

4.4 Refunds

Fees are non-refundable except where required by applicable law. If you cancel your subscription, you will retain access to the Service until the end of your current billing period. We do not provide partial or prorated refunds.

4.5 Price Changes

We reserve the right to change our pricing at any time. We will provide reasonable advance notice of material price increases via email or in-app notification. Price changes will take effect at the start of your next billing cycle.

5. Your Data

5.1 Ownership

You retain all rights to the data you collect and store through the Service ("Your Data"). We do not claim ownership over Your Data.

5.2 License to Process

You grant us a limited, non-exclusive license to process Your Data solely for the purpose of providing, maintaining, and improving the Service. This includes hosting, storage, aggregation, anonymization, and the generation of analytics reports on your behalf.

5.3 No Resale of Data

We do not sell, rent, or trade Your Data to third parties for their marketing or commercial purposes.

5.4 Data Portability and Deletion

You may export Your Data at any time using the Service's export features. Upon termination of your account, we will delete or return Your Data within 30 days, except where we are required to retain certain data for legal, regulatory, or legitimate business purposes.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Collect personal information of end users without proper legal basis or disclosures
  • Transmit malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to the Service, other accounts, or connected systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to build a competing product or service
  • Exceed applicable rate limits or abuse the API in ways that degrade service for others
  • Use automated means (bots, scrapers) to access the Service without our written permission

7. Tracking Script and Data Collection

Our tracking script is designed to collect analytics data from visitors to your websites and applications. You are responsible for:

  • Providing appropriate privacy notices to your end users about your use of analytics
  • Obtaining any necessary consent required by applicable privacy laws (e.g., GDPR consent banners where applicable)
  • Ensuring your use of the tracking script complies with all applicable laws and regulations

hight is designed as a privacy-first analytics tool. Our tracking script does not use cookies for cross-site tracking. Session and device data is collected in accordance with our Privacy Policy.

8. AI Assistant

The Service includes an AI-powered analytics assistant that uses third-party language models to provide insights about Your Data. When you interact with the AI assistant:

  • Your queries and relevant analytics context are sent to our AI infrastructure provider for processing
  • We do not use your data to train language models
  • AI-generated responses are provided for informational purposes and may contain errors; you should not rely on them as the sole basis for business decisions
  • We reserve the right to modify, limit, or discontinue the AI assistant feature at any time

9. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is owned by hight and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. This license does not include the right to:

  • Copy, modify, or distribute any part of the Service
  • Use our branding, logos, or trademarks without prior written consent
  • Use the Service for any purpose not expressly permitted by these Terms

10. Third-Party Services

The Service integrates with and relies on third-party services, including but not limited to payment processing (Stripe), cloud infrastructure, and AI providers. Your use of these third-party services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.

11. Service Availability and SLA

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We may temporarily suspend or restrict access to the Service for maintenance, updates, or circumstances beyond our reasonable control. We will make reasonable efforts to provide advance notice of scheduled maintenance.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory
  • We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • In no event shall hight, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service
  • Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid to hight in the 12 months preceding the claim or (b) one hundred U.S. dollars ($100)

13. Indemnification

You agree to indemnify, defend, and hold harmless hight and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable law or third-party rights
  • Your failure to provide appropriate privacy notices to your end users

14. Termination

14.1 By You

You may cancel your subscription and terminate your account at any time through your account settings. Cancellation takes effect at the end of your current billing period.

14.2 By Us

We may suspend or terminate your access to the Service immediately upon written notice if you breach these Terms, fail to pay applicable fees, or if we reasonably believe your use poses a security risk to the Service or its users.

14.3 Effect of Termination

Upon termination:

  • Your right to access and use the Service ceases immediately (or at the end of the billing period, for voluntary cancellations)
  • We will delete your account data within 30 days, except as required by law
  • Provisions of these Terms that by their nature should survive termination will survive, including Sections 5 (Your Data), 9 (Intellectual Property), 12 (Limitation of Liability), 13 (Indemnification), and 16 (Governing Law)

15. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date and, where appropriate, notifying you via email or in-app notification. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware, and you consent to the personal jurisdiction of such courts.

17. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and hight regarding the Service.
  • Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
  • Assignment: You may not assign these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • Force Majeure: We are not liable for any failure or delay in performance due to causes beyond our reasonable control.
